The USCIS statistics on DACA Initial cases for the second quarter of FY2016, from 1/1/16 to 3/31/16 show a total of 14,495 DACA requests accepted for processing, (N/A) biometric services appointments scheduled, 13,540 requests approved, and 2,571 requests have been denied.

The USCIS statistics on DACA Renewal cases for the second quarter of FY2016, from 1/1/16 to 3/31/16 show a total of 29,296 DACA requests accepted for processing, (N/A) biometric services appointments scheduled, 25,991 requests approved, and 766 requests have been denied.

USCIS has announced that they have accounted for over 99% of the invalid work permits they issued to some DACA recipients. Of the more than 2,600 invalid work permits, only 22 failed to return them or show good cause for not doing so by the July 30th deadline. The 22 recipients that failed to respond have been terminated from the DACA program.

In response to the injunction in Texas v. United States, USCIS is requiring approximately 2,000 individuals to whom 3-year Employment Authorization Documents (EAD) were issued after the February 16, 2015 injunction, to return their EADs to the USCIS by July 17th or show cause.

The USCIS letter sent to the affected individuals stated, “USCIS must receive your EAD by 7/17/15. Failure to return the invalid EAD without good cause may affect your deferred action and employment authorization.”

This does not affect EADs that were issued before the injunction. Also, and most important – these affected individuals have already been issued a new 2-year EAD as a replacement for the invalid 3-year EAD.

– What is Deferred Action for Childhood Arrivals?

The United States Citizenship and Immigration Services (USCIS) will be a holding a free Teleconference on Wednesday, June 24, 2015 between 2:00pm to 3:00pm (EST). The subject of this event will be their continued processing of requests under the original guidelines for Deferred Action for Childhood Arrivals (DACA) and the DACA renewal process. There will also be a Q&A session at the end of the teleconference.

The federal court temporarily enjoined the USCIS from implementing the new expanded DACA guidelines under President Obama’s Executive Actions on Immigration (11/20/14).

When your initial two-year grant of deferred action for childhood arrivals (DACA) expires, you may request a renewal. USCIS suggests you submit your DACA renewal request up to150 days before the expiration date located on your current Form I-797 DACA approval notice and Employment Authorization Document (EAD). Some people are waiting too long to request their DACA renewal or not submitting the correct forms and fees and as a result their EAD could expire before USCIS processing their DACA renewal.

You can lessen the chance that this may happen if you:

• File on time. Submit your renewal request between 150 days and 120 days before the expiration date listed on your current Form I-797 DACA approval notice and Employment Authorization Document.
