What We Know about the H-1B Presidential Proclamation:
- Current H-1B workers in the U.S. should not be impacted by the Proclamation.
- The $100,000 fee applies only to new petitions filed on or after September 21, 2025.
- International Travel appears possible for current H-1B visa holders; however, our law firm advises against any international travel at this time.
The language as contained in the proclamation is extremely unclear which has caused considerable confusion for both U.S. Employers and H-1B Employees.
We will continue to provide updates as more concrete information becomes available concerning the H-1B Presidential Proclamation.
It is highly recommended that Employers speak with Immigration Counsel concerning any hiring decisions, and for Employees to speak with Immigration Counsel if considering international travel.
