Question #1 – H-1B Nonimmigrant Visa 

How long do you have to work in the US under H-1B before you can apply for an I-140? 

Answer #1 – There is no specific set time frame, as an applicant who has never been in the U.S. can be sponsored for an employment based green card by a U.S. employer. 

 

Question #2 – Conditional Permanent Residence 

How do I remove my conditions on my Conditional Green Card? 

Answer #2 – File Form I-751, Petition to Remove Conditions on Residence with the USCIS, within 90 days of the expiration of the conditional permanent resident card. You should file the petition jointly with your spouse through whom you obtained conditional status. However, certain exceptions do exist that may allow you to apply for a waiver of the joint filing requirement. 

 

Question #3 – Citizenship Resource Center 

If I have been a Green Card Holder for 8 years, am I eligible to Apply for Citizenship? 

Answer #3 

The general requirements for administrative naturalization include: 

  • A period of continuous residence and physical presence in the United States;
  • Residence in a particular USCIS District prior to filing;
  • An ability to read, write and speak English;
  • A knowledge and understanding of U.S. history and government;
  • Good moral character;
  • Attachment to the principles of the U.S. Constitution; and,
  • Favorable disposition toward the United States

  

Question #4 – H-1B Nonimmigrant Visa 

Is there any limit to how many times I can apply for an H1B transfer? 

Answer #4 – No. 

 

Question #5 – Visa Bulletin 

Where can I find the visa bulletin numbers? 

Answer #5 – On the U.S. Department of State website: Visa Bulletin 

 

Question #6 – Citizenship and Naturalization 

Will I be asked all 100 civics questions during the naturalization interview? 

Answer #6 – No. You will be asked 10 questions out of the possible 100 civics questions. You must correctly answer 6 out of the 10 questions ask by the interviewer to pass.

Question #7 – B-1 Temporary Business Visitor Visa 

How long can someone stay in US on a Business Visa (B1/B2)? 

Answer #7 – You may receive a Visitor Visa valid for 10 years; however, the maximum duration of stay in the United States on a B1/B2 visa is 6 months. 

  

Question #8 – Advance Parole (AP) 

If my Advance Parole is about to expire and I don’t plan to travel outside of the US within the next year, do I have to renew it? 

Answer #8 – No; however, it may be a good idea to renew it – just in case, as you never know when things may happen that require you to travel abroad with short notice. 

  

Question #9 – Green Card – Family Based Immigration 

If I applied for an I-130 outside of the US, do I have to come to the US for my interview appointment? 

Answer #9 – If you filed from outside of the U.S., and are still presently outside of the U.S., then you would attend an interview at the Consulate/Embassy, not in the U.S. 

  

Question #10 – L-1 Intracompany Transferee Work Visa 

Can spouses of L1 visa-holders work in the US? 

Answer #10 – Yes, spouses of L-1 nonimmigrant visa holders are eligible to apply for L-2 dependent nonimmigrant visa status which allows for employment authorization.
